Customer Ratings and Reviews terms and conditions

These Terms of Use govern your conduct associated with the Customer Ratings and Review service offered by Target Australia (the "CRR Service"). To the extent of any conflict between Target Australia's Privacy Policy and these Terms of Use, these Terms of Use shall control with respect to the CRR Service.

By submitting any content to Target Australia, you represent and warrant that:

• you are the sole author and owner of the intellectual property rights thereto;
• all "moral rights" that you may have in such content have been voluntarily waived by you;
• all content that you post is accurate;
• you are at least 16 years old;
• use of the content you supply does not violate these Terms of Use and will not cause injury to any person or entity.

You further agree and warrant that you shall not submit any content:

• that is known by you to be false, inaccurate or misleading;
• that infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
• that violates any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising);
• that is, or may reasonably be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership or corporation;
• for which you were compensated or granted any consideration by any third party;
• that includes any information that references other websites, addresses, email addresses, contact information or phone numbers;
• that contains any computer viruses, worms or other potentially damaging computer programs or files.

You agree to indemnify and hold Target Australia (and its officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers, including but not limited to Bazaarvoice, Inc.), harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown including reasonable attorneys' fees, arising out of a breach of your representations and warranties set forth above, or your violation of any law or the rights of a third party.

For any content that you submit, you grant Target Australia a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world without compensation to you.

All content that you submit may be used at Target Australia's sole discretion. Target Australia reserves the right to change, condense or delete any content on Target Australia's website that Target Australia deems, in its sole discretion, to violate the content guidelines or any other provision of these Terms of Use. Target Australia does not guarantee that you will have any recourse through Target Australia to edit or delete any content you have submitted. Ratings and written comments are generally posted within two to four business days. However, Target Australia reserves the right to remove or to refuse to post any submission for any reason. You acknowledge that you, not Target Australia, are responsible for the contents of your submission. None of the content that you submit shall be subject to any obligation of confidence on the part of Target Australia, its agents, subsidiaries, affiliates, partners or third party service providers and their respective directors, officers and employees.

By submitting your email address in connection with your rating and review, you agree that Target Australia and its third party service providers may use your email address to contact you about the status of your review and other administrative purposes.

 

Target Gift Cards Conditions of use

This agreement is a contract between the customer ("you") and Target Australia Pty Ltd. Please read the following conditions of use carefully before placing your order with Target Online. By completing and submitting the customer gift card order form online and using the Target Online service, you acknowledge that you have read and agree with the conditions of use outlined below.

Target Online reserves the right at all times to make changes to the Conditions of Use, offers, bonuses and rewards at its sole discretion without prior notice.

1. Definitions

The following apply to these Conditions of Use.

Agreement means an agreement between you and Target Australia Pty Ltd to supply Goods. Delivery Address means the address to which the Goods are to be delivered as stated on the Order.

Goods means Goods described in an Order (including Gift Cards).

Order means an order by you to purchase Goods from Target Australia Pty Ltd. Personal Information includes, but not limited to your name, Delivery Address and payment details.

2. Payment

You agree to pay the delivery fee in respect to each gift card order placed.

Method of Payment

You may use MasterCard, Visa, American Express and Diners cards. Target Online does not accept other forms of tender for the purchase of goods. Payment must be cleared before goods are dispatched.

ID requirements

If the total of the Target Gift Card purchased exceeds $400.00, the customer maybe contacted by a member of the Online Shopping team with a request for additional information including but not limited to photo identification.

3. Delivery

Gift Cards are only available for delivery within Australia.

Please note that each Gift Card order is delivered individually and cannot be bundled together. As such a separate delivery fee applies for each separate order placed.

Delivery Charges

For Target Online Gift Card purchases a delivery fee of $3.00 applies for each Gift Card order.

Risk & Title

Risk and title in the Goods passes to you upon delivery of the Goods to your nominated Delivery Address.

Delivery Requirements

Target Online does not make Goods available for collection.

Target on-line gift card purchases are delivered via registered post.

Remote Areas

Australia Post does not deliver to some remote areas, therefore additional charges may apply. For a quote or further assistance, please contact 1300 TARGET (1300 821 432) during business hours.

Delivery Conditions

Goods cannot be delivered to a P.O Box address.

A person must be at the Delivery Address to accept the goods on delivery. Anyone at the Delivery Address who receives the Goods shall be presumed to be authorised to receive the Goods on your behalf. If there is no-one at the Delivery Address or no-one of the appropriate age to receive the Goods (or the person is unable or unwilling to provide appropriate proof of age), a calling card will be left for you to collect the Goods from the post office. Target Online will not accept responsibility for late delivery or non-delivery due to incomplete or incorrect details provided.

4. Refunds/Returns

Gift Cards cannot be exchanged for another denomination or tender (i.e. cash).

Please note that Target is not responsible for and is unable to replace gift cards, which are lost or stolen.

Gift Cards cannot be refunded or returned, unless required by law.

Please note that delivery fees are non refundable, unless required by law.

5. Cancellations

Orders may only be cancelled if an email is sent to onlineshopping@target.com.au by 9.00am(AEST) the next business day (please account for state based public holidays) from the time of placing the order, after which the Goods will be delivered. Refer to clause 4 for Conditions of Use for refunds/returns.

6. Gift Card

7. Privacy and Security

Personal information collected will be used for the purpose of processing the order, and may be shared with a third party delivery agent and other parties necessary for the purposes of delivering your order. 8. Applicable Laws

The laws of Victoria, Australia govern this agreement
